By using this Site you consent and agree to the terms and conditions contained in this Agreement. These terms and conditions (“Agreement”) applies to use of the cupcakenoggins.com website located at http://www.cupcakenoggins.com (the “Site”). The Site is a propreitorship (SEPL, “we”, “our”, “us”).
cupcakenoggins.com makes and sells Bakery & Confectionary & related paper based items that allows you to place your order either online, on phone or email and get them delivered at your door step. We deliver goods through either our own delivery service or third party delivery systems.
Cut Off Time: All orders should be placed 72 hours prior to delivery date. The images displayed on the site in indicative in nature. Actual product may vary in shape or design as per the availability
Customer can place order in two different ways.
1) ONLINE ORDER :
Customer can place order on our website www.cupcakenoggins.com and make the payment via different payment options like Credit Card, Debit Card, Net Banking, Bank Deposit.
Note: Please refer to payment section below for further details.
Customer can directly send an email to email@example.com to place an order.
Our customer care executives will reply/call the customers to confirm the order.
2) PHONE ORDER :
User can Text/Call us directly on our phone numbers mentioned in the “Contact page” of the website to place an order. This facility is available only Mondays to Saturdays between 9 am and 6 pm.
Note: For Phone order, cupcakenoggins representatives will call/text/email to confirm the order and assist the user to proceed to payment if required.
Each product or service you order on our site, you agree to pay the price applicable for the product or service (including any sales taxes, surcharges and any delivery fees for the delivery service you select) as of the time you submitted the order.
All orders will be confirmed after placing the order. You will receive an Order Confirmation e-mail/text. Please put this in a safe place, as it will include all the details of your order, in the event you need to contact us.
Your receipt of an electronic or other form of order confirmation does not signify our acceptance of your order, nor does it constitute confirmation of our offer to sell. We reserve the right at any time after receipt of your order to accept or decline your order for any reason. We reserve the right at any time after receipt of your order, without prior notice to you, to supply less than the quantity you ordered of any item. We may require additional verifications or information before accepting any order.
Your order is not accepted until your payment has been successfully made and we send you shipping information for the order (or the accepted portion thereof).
Notwithstanding the foregoing, you agree that, if we cancel all or a portion of your order or if we provide you less than the quantity you ordered, your sole and exclusive remedy is either
(a) We will issue a credit to your credit card account in the amount charged for the cancelled portion or the quantity not provided (if your credit card has already been charged for the order) or
(b) We will not charge your credit card for the cancelled portion of the order or the quantity not provided.
ORDER MODIFICATION / CHANGES / CANCELLATIONS:
No change in instructions will be accepted after 24 working hours prior to the delivery date and time. Cupcakenoggins will not be able to cancel or change orders already in process, en route or delivered.
PROBLEMS WITH ORDER:
At cupcakenoggins, we make every effort to ensure that you receive prompt service. If, at any time, you experience problems with an order, please feel free to drop us a line.
Note: Any complaint for our perishable products like cake, cupcakes, candies, savouries etc should be raised within 1hour from the time of delivery
In order to check the status of an order, customer can call/email. Giving the Phone number of the delivery recipient is a must to facilitate the delivery boy to locate the address. In case of non-availability of the ordered products, we will first try contacting the customer to inform of the same and offer alternate suggestions.
Cupcakenoggins cannot commit 100% fixed delivery time which is mentioned by the customer in the Special Instructions during checkout. All deliveries will be made between 11 am to 7 pm on the given date. To request a specific delivery time, please type it into the note for special Instructions field during checkout. We will do our best to accommodate your preferences.
Call/Text us to check availability or if we can deliver in a specific time.
Note: We reserve the right to make deliveries in installments in case you have ordered more than one product, which shall not relieve you from your obligation to accept and pay for remaining deliveries. Our service providers sometimes will not be able to telephone prior to delivering packages, and we cannot guarantee the time of delivery.
SAME DAY DELIVERY:
Same day delivery is possible in Bangalore currently for products like Cakes and Cupcakes. However, this should be first confirmed over the phone via a text/call with us before confirming the order. Same day delivery is not possible for other products like custom theme cakes, items in the Candy and Savoury section.
Orders received after time may be delivered the following day.
We make deliveries on all 6 days in a week barring sundays. For some causes like Public emergency holidays, natural calamities we cannot guarantee delivery.
DELIVERY ATTEMPTS AND REFUND:
We will attempt delivery of the items ONCE. All products are deemed accepted upon our delivery of the product to you or your designated recipient’s address. In case the delivery is not executed during the attempt, the customer shall still be charged for the order and no redelivery will be possible. We will consider the order as “executed” in the following cases. cupcakenoggins is not responsible and does not guarantee refund for cases where:
- Delivery not done due to wrong address supplied by sender however we would try our best to reconfirm with the client for the delivery address.
- Recipient not available especially in Hotels, Hostels and Gated Communities.
- Premises locked.
- Wrong phone/ Cell or Extension number/ not working / no reply or not connecting / reachable and delivery is not done.
- Recipient refused the products
- Delivered the product at the Gate / Reception / Neighbour.
- Product quality problems caused by improper handling by the recipient.
Before major holidays and festivals, we recommend that you place your orders at least five days in advance. Cupcakenoggins will attempt to deliver a product on the requested delivery day. You acknowledge that requested delivery dates are non-binding estimates only and that you have no claim against us for any delays or early deliveries.
Delivery of certain items may not be possible/delayed under certain uncontrollable circumstances such as ingredients not available in the market or discontinued by the manufacturer or supplier, massive power outages. In such cases, similar product nearest to the description shall be delivered. In case of natural calamities, extreme weather conditions, (flooding, quake, heavy rains), national bandh etc. we reserve the right to reschedule the delivery for another date. In such cases a written communication will be sent to the customer on email for a confirmation for the same. However, if there is no response from the customer within 24 hours, it shall be assumed that she/he has agreed to the delivery of the alternate product and on alternate date
Our delivery fee varies depending on the distance of the recipient address from the Sarjapur address given on the checkout page.
We deliver and ship products to only certain areas of Bangalore as listed in our “Checkout page”.
Cancellation during Normal days:
Can be cancelled within 48 working hours prior to delivery time.
Cancellation during Holidays:
During holidays for all confirmed orders on all products cupcakenoggins does not allow orders to be edited or cancelled within 48 hours prior to the requested date of delivery , or within the seven (7) days prior to Valentine’s, New Year’s, Thanksgiving, Christmas, special holidays Father’s Day or Mother’s Day, because of our extremely high volume of orders during these times.
Special offers, coupons, or discounts cannot be used in conjunction with other offers. Limit one promotion per order.
All prices listed on the Website are subject to change. In the event a product is listed at an incorrect price or with incorrect information due to typographical error or error in pricing or product information received from our suppliers, we shall have the right, prior to the acceptance of your order pursuant to our Order Acceptance Policy described below, to refuse or cancel any such orders whether or not the order has been confirmed and your credit card charged. If your credit card has already been charged for the purchase and your order is canceled, we shall immediately issue a credit to your credit card account in the amount of the charge. Please note that the colors of items and products may depend on your monitor and may not be correctly displayed. The availability of products and other items on each of the Sites may change at any time, without notice.
You agree that the prices are acceptable. You acknowledge, agree and understand that our website prices reflect numerous factors such as, but not limited to, purchased cost, overhead, delivery, labor, packaging, handling and advertising fees. You acknowledge, agree and understand that our prices may not be the same as the prices found at any store offline or online and may be higher priced. You acknowledge, agree and understand that when ordering an item or items listed on our website we reserve the right to choose the item on your behalf. You acknowledge, agree and understand that our prices on our website may change at any time and should the price change lower after you had purchased the item, you agree to accept the price you had paid. Prices can change even within the day due to market prices, our suppliers and/or service providers.
You acknowledge, agree and understand that our delivery fee that is charged does not reflect our actual delivery fee cost. Some charges of delivery may be included within the pricing of the product.

Customer can visit the branch directly to deposit the payment or can transfer the payment through net banking. Bank details on our website “Checkout Page”
For each product or service you order on any of the Sites, you agree to pay the price applicable for the product or service (including any sales taxes, surcharges and any delivery fees for the delivery service you select) as of the time you submitted the order.
In the event that any payment is subsequently declined, the order will not be released or completed until alternative funding arrangements have been agreed and payment made in full. Subsequent completion of the order will be subject to availability and cannot be guaranteed. Cupcakenoggins.com accepts no liability for any loss howsoever caused or for non-delivery under these circumstances. The customer will be responsible for the payment of any additional charges which have been incurred as a result of payment failure.
Refund could be processed if it is agreed upon and communicated in writing to the customer.
Types of Refund:
Refund is credited directly through the mode from which customer has paid the money (Credit Card, Bank Transfer)
If the customer has paid in Cash/Bank Deposit the Refund will made via netbanking takes 3-4 working days.

Due to the constant change of products, stock is not always available thus we reserve the right to make substitutions. Should a particular item ordered not be available, substitutions of the item, in equal value, will be made. Substitutions are applicable for all products found on the website. Substitutions can be in the form of, but not limited to, size, shape, color, kind, type, material and matter.
